Terms and Conditions of Sale

1. Introduction

Read the complete Terms of Sale of LoonyHub.com. By placing an order, you agree to our terms, confirm that you are of legal age according to your local laws, and acknowledge that you understand how digital and physical products are managed.

This document governs the terms and conditions of sale of digital and physical products offered on www.LoonyHub.com (hereinafter, the “Site”), owned by LoonyHub LLC, a company registered in Greenville, New Castle County – Delaware 19807 – USA.
Purchasing from the Site implies full and unconditional acceptance of these Terms and Conditions. Users are therefore advised to read them carefully before placing an order.

2. Product Types

LoonyHub creates and distributes digital artwork and physical posters in limited editions and thematic capsules.

Available product categories include:

  • Digital files in high-resolution format, downloadable after payment.
  • Physical posters in large format (see product sheet for dimensions), printed on museum-quality art paper, shipped in a sealed protective tube.

Each capsule or artwork may only be available for a limited period. Once availability ends, the work will not be reprinted or made downloadable again. This reflects LoonyHub’s philosophy, not a marketing strategy.

3. Prices and Payments

All prices are indicated in US Dollars (USD) and include VAT where applicable.
The price displayed on the Site at the time of order is the actual and final price.

Accepted payment methods:

  • Credit/debit cards (Visa, Mastercard, American Express)
  • PayPal
  • Other digital payment methods indicated on the Site

Payment is required in a single upfront installment. Orders will not be processed until payment is confirmed.

4. Digital Products – Download and License

Purchasing a digital file grants the customer the right to download and use the file exclusively for personal or decorative purposes.

Non-Commercial Personal Use License
This license allows the buyer to use the file for:

  • Single prints for personal use (e.g., printing a poster, t-shirt, mug, or other items for personal use only, not for resale).
  • Phone, PC, laptop wallpapers, or Digital Art Display screens (e.g., Samsung The Frame).
  • Use as a status symbol in personal digital spaces.

Prohibited uses include:

  • Reselling, sharing, or distributing the digital file;
  • Using it for commercial purposes or creating derivative products for sale;
  • Modifying the file to remove any LoonyHub or author signatures or references.

Each download is personal and tracked. In case of violation, LoonyHub reserves the right to take legal action to protect its works and brand.

Exclusive Commercial Licenses
All digital files available on LoonyHub.com are intended for personal, non-commercial use unless otherwise indicated.
If you wish to obtain an exclusive commercial license to use one or more LoonyHub files for professional or profit purposes (e.g., for a brand, company, or commercial project), please contact us via email at info@loonyhub.com. We will provide all necessary information to evaluate and complete the license purchase.

5. Physical Posters – Production and Shipping

Physical posters are produced on demand once payment is confirmed and printed in collaboration with specialized suppliers.

Estimated production and shipping times:

  • Production: 1–2 business days
  • Shipping: 3–15 business days (depending on destination)

Each poster is shipped in a rigid tube or protective container, sealed.
LoonyHub is not responsible for delivery delays caused by couriers or force majeure events (strikes, customs, natural events, etc.).

6. Return Policy and Right of Withdrawal

Digital Products
Digital files are considered non-returnable.
Once downloaded, no refunds are available, as the product is immediately usable.
Exceptions are made for damaged files or files with insufficient resolution; in such cases, LoonyHub will provide replacement files.

Physical Posters
Since posters are made on request, the right of withdrawal does not apply, except in cases of printing defects, production errors, or delivery of a product different from the one purchased.
In such cases, the customer may report the issue within 7 days of delivery by emailing info@loonyhub.com, attaching detailed photos of the product and the order number.
LoonyHub will, after verification, provide a free replacement or, if not possible, a refund of the amount paid.

7. Availability and Limitations

Each LoonyHub capsule is limited in time.
Once availability ends, works will not be reproduced or reprinted.
This is not a marketing strategy but a natural selection consistent with the brand’s philosophy.

8. Intellectual Property

All content on LoonyHub.com (texts, images, graphics, videos, trademarks, logos, digital and physical works) is protected by copyright and is the exclusive property of LoonyHub and/or respective authors.
Any reproduction, distribution, modification, or unauthorized use of Site content is strictly prohibited.

9. Limitation of Liability

1. Digital Files
LoonyHub shall not be liable for direct or indirect damages resulting from:

  • Improper or unauthorized use of digital files;
  • Technical issues or device malfunctions used to open or print files;
  • Minor color differences between digital images and physical products created by the customer (standard printing tolerance).

2. Physical Products – Posters
Posters are shipped in protective tubes or protective packaging, to ensure integrity during transport. However:

  • LoonyHub is not responsible for damage caused by the courier during delivery.
  • Customers are required to inspect the package upon delivery and may:
  • Accept with reservation, notifying the courier of any damage;
  • Refuse delivery if the package appears damaged.
  • LoonyHub will assist customers with claims to the courier but cannot be held liable for damages during transport.

3. General Warranty
All products are provided “as is,” with maximum artisanal care and attention, but without any implied warranty beyond those required by law.

10. Privacy and Data Protection

LoonyHub processes customer personal data in accordance with applicable local privacy laws.

  • For EU customers: personal data is handled in compliance with the EU General Data Protection Regulation.
  • For customers outside the EU: local privacy regulations apply.

Collected data is used solely for order management, communications related to LoonyHub products and services, and legal compliance.

11. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the State of Delaware, USA.
Any disputes shall be subject to the exclusive jurisdiction of the state or federal courts in Delaware, unless otherwise mandatorily provided by law.
